Suspended Kanawha magistrate denies allegations

CHARLESTON, W.Va. -- A suspended Kanawha County magistrate denies allegations of ethical violations.

Longtime Magistrate Carol Fouty told the Charleston Daily Mail in an email that the only thing she's done is dismiss a ticket.

Fouty said that if she's going to be prosecuted for dismissing a ticket, then the state would have to prosecute every magistrate and circuit judge.

The West Virginia Supreme Court suspended Fouty without pay earlier this month. She is accused of dismissing a citation without a prosecutor present, allowing defendants to work at her home to pay back a bond facilitator, as well as other alleged violations.

Fouty, a Republican, has served as a magistrate since her election in 1998. She also served as magistrate from 1983 to 1995.
