WINFIELD, W.Va. -- The trial of a Poca man charged with 20 counts of possessing child pornography began Monday in Putnam County Circuit Court.Police seized the computer of William Burt Shingleton, 45, in April 2010 after obtaining a search warrant from retired Putnam Circuit Judge O.C. Spaulding, according to a criminal complaint filed in Putnam County Magistrate Court.According to the complaint, filed by Sgt. R.E. Lockhart of the Putnam County Sheriff's Department, the FBI forensic analysis lab issued a report on Aug. 10, 2011, about what was found on Shingleton's computer.The search found numerous pictures of naked juveniles in provocative poses, Lockhart wrote in the complaint.
Shingleton, who is being represented by Buffalo attorney James Atkins, was indicted in March on 20 counts of possessing material visually portraying a minor engaged in sexually explicit conduct.Putnam County Circuit Judge Phillip Stowers is hearing the case. Shingleton could face up to 40 years in prison if he is found guilty.According to the Kanawha County Circuit Clerk's office, Shingleton was found guilty of forgery in 1993, and of obtaining by false pretenses in 2008.After he violated probation tied to the 2008 case, Shingleton was sentenced to one to 10 years and he has been incarcerated since last August, according to the circuit clerk's office.He is being held in the Western Regional Jail during the trial.
