Fourth Circuit to hear arguments at WVU law school

MORGANTOWN, W.Va. -- The 4th U.S. Circuit Court of Appeals is coming to Morgantown.It will hear oral arguments Thursday at the West Virginia University College of Law, starting at 9 a.m.Dean Joyce McConnell says that in one case, the panel will consider whether a party can be required to arbitrate under a performance bond subcontract.
In a separate employment discrimination case, the court will consider whether the plaintiff is considered disabled under the Americans with Disabilities Act, and whether the American Red Cross chapter is an employer in the case.The third case centers on whether a prisoner's cell mate acted as a state agent in eliciting incriminating statements, and whether conduct by state actors can be used in federal prosecutions.The 4th Circuit is located in Richmond, Va.
