Family of deputy killed by DUI on I-79 to get $2M

MORGANTOWN, W.Va. -- The family of a Monongalia County sheriff's deputy killed by a drunken driver will share a $2 million award under a proposed lawsuit settlement.The Dominion Post says the money will be divided among the parents and brother of Sgt. Todd May, and their attorneys.The family sued Morgantown motorist Jerod Green, who was convicted last year of causing the Interstate 79 crash in Pennsylvania.Two insurance companies will settle the claims on Green's behalf.
Progressive will pay only Green's $20,000 policy limit.But May had underinsured motorist coverage through his job, so Charter Oak Insurance will pay that policy limit -- $2 million.Green was a repeat offender. He is now serving a 25- to 50-year prison sentence.Lawsuits against the bars that served Green remained unresolved Thursday.
