Former Weirton mayor seeks dismissal of charges
NEW CUMBERLAND, W.Va. -- A former Weirton mayor accused of embezzlement has asked a judge to dismiss the charges.
Mark Harris is accused of stealing more than $16,000 donated for a skate park.
The Weirton Daily Times reports that Harris' attorney, William E. Galloway, filed a motion recently in Hancock County Circuit Court arguing that the funds were private money raised by Harris and weren't the city's property. The motion contends that the allegations don't fit West Virginia's statutory definition of embezzlement.
Another defense motion seeks to suppress evidence obtained through a subpoena.
A hearing date hasn't been set.
Harris was indicted in September on embezzlement and conspiracy charges. His wife was charged with conspiracy.
Harris served one term and didn't seek re-election in 2011. The couple now lives in Myrtle Beach, S.C.
