CHARLESTON, W.Va. -- A Pond Gap man was arrested on Thursday after allegedly opening fire on his brother after an argument.West Virginia State Police spokesman Sgt. Michael Baylous said troopers from the Quincy detachment went to a house on Bell Creek Road near Pond Gap at about 11:15 a.m. to respond to a 911 call. They met Timothy Lyons, 61, walking down the road. Baylous said the man told them his brother, Howard Lyons, 67, of Pond Gap, had shot at him with a 9mm handgun.
Baylous said Timothy and Howard Lyons had been arguing over an apple tree. Timothy Lyons was walking away from the fight and was about 50 yards away when his elder brother allegedly pulled the gun and started shooting.Baylous said troopers caught up with Howard Lyons a short time later and recovered both the pistol and spent shell casings. Howard Lyons was arrested and charged with wanton endangerment with a firearm, a felony, and brandishing, a misdemeanor. Howard Lyons was awaiting arraignment Thursday afternoon in Kanawha County Magistrate Court.
