Mercer judge rejects ex-teacher's plea deal
PRINCETON, W.Va. -- A Mercer County judge has rejected a plea agreement for a former teacher accused of sex crimes involving students.
Former PikeView High School physical education teacher Jonathan Kirk pleaded guilty last November to one count of sexual abuse and six counts of distribution of obscene material to a minor child.
Kirk was scheduled to be sentenced Friday. Media outlets report that Circuit Court Judge William Sadler rejected the plea agreement and scheduled trial for April 15.
Sadler said the plea agreement didn't take Kirk's position as a teacher into account. The judge also expressed reservations about presentencing and sexual offender evaluation reports filed in the case.
