Hearing set on prosecutor's domestic violence petition
CHARLESTON, W.Va. -- A Cabell County family court judge will hold a final hearing later this month on a domestic violence protection order taken out against Kanawha County Prosecuting Attorney Mark Plants by his ex-wife.Allison Plants alleged that the prosecutor had "abused one of his children by disciplining him in an excessive manner," according to State Police.
A Kanawha County family court judge granted an emergency protective order that prohibited Mark Plants from contacting his children or his ex-wife. All Kanawha County judges then recused themselves from the case, and state Supreme Court officials named Mercer Circuit Judge Derek Swope and Cabell Family Court Judge Patricia Keller to hear the case.Supreme Court spokeswoman Jennifer Bundy said Keller has scheduled a final hearing on the protective order at 9:30 a.m. on March 21 at the Cabell County Courthouse. Under state law, the hearing is closed to the public.
State Police are also investigating the allegations. Swope has not assigned a special prosecutor in the case, Bundy said Wednesday.
