Report: Hurricane man competent to stand trial


WINFIELD, W.Va. (AP) — A psychiatrist has determined that a Hurricane man is competent to stand trial on a charge of killing his infant son.

The evaluation of 33-year-old Robert Jeremy Smith was filed Thursday in Putnam County Circuit Court.

Smith is charged with death of a child by a parent as a result of child abuse. His 5-week-old son, Madden, was found dead in a car in Kanawha City on May 21.

Smith told police Madden died after he accidentally dropped him. Defense attorney Shawn Baylis said he believes evidence will show it was an accident.

Authorities say the child appeared to have suffered multiple skull fractures, and a hammer with blood on it was found in the home where Smith had been watching his son.
