Trial reset for couple accused of causing infant's death

A man and woman accused of causing the death of an 8-month-old baby last year are set to stand trial in September.

Kanawha Circuit Judge Joanna Tabit on Monday rescheduled the trial for William Ellis Bowen IV and Chellbie Elaine Hudson after a physician, who is a witness in the case, was not available to testify.

Tabit rescheduled the trial for Sept. 16, and told attorneys in the case she expects everyone to have all their “ducks in a row,” saying the case has been pending for quite some time.

Hudson, 26, is charged with one count each of child neglect resulting in death and child neglect creating a substantial risk of serious bodily injury.

A conviction for child neglect resulting in death carries a sentence of between three and 15 years in prison, plus between $1,000 and $5,000 in fines. For child neglect creating substantial risk of serious bodily injury, a conviction carries a sentence of between one and five years in prison and between $1,000 and $3,000 in fines.

Bowen, 33, of St. Albans, is charged with child neglect resulting in death and death of a child by parent, guardian or custodian.

A conviction for death of child by a parent, guardian or custodian carries a sentence of between 15 years and life in prison.

Hudson and Bowen are accused of causing the death of Hudson’s daughter, 8-month-old Lillyann Hudson, in June 2018.

Lillyann was transported to Charleston Area Medical Center Women’s and Children’s Hospital from a house along Buckeye Lane, in St. Albans, on June 23, Kanawha County Sheriff’s Detective J.A. Payne said in a criminal complaint filed in Kanawha County Magistrate Court.

Deputies found Lillyann “unresponsive and barely breathing. She died within 48 hours of her arrival at the hospital, Payne said.

Chellbie Hudson was Lillyann’s mother, and Bowen was Hudson’s live-in boyfriend at the time Lillyann died, according to the criminal complaint.

Hudson and Bowen are incarcerated at the South Central Regional Jail.
